FWIXIT – TERMS OF SERVICE

Welcome to Fwixit, an online marketplace connecting clients with freelance service providers ("Freelancers”).
By accessing or using Fwixit, you agree to comply with and be bound by these Terms of Service ("Terms”).
If you do not agree with these Terms, you must not use the platform.

These Terms apply to all users, including Clients and Freelancers, and form a binding agreement between you and Fwixit ("we”, "us”, "our”).


1. ABOUT FWIXIT

Fwixit is a UK-based online marketplace that enables Clients to purchase digital and technical services from Freelancers.
We provide a platform to facilitate communication, payment processing, and project delivery, but we are not a party to any contract between a Client and a Freelancer.


2. ELIGIBILITY

To use Fwixit, you must:

  • Be at least 18 years old.
  • Have legal capacity to enter into a binding contract.
  • Use the platform in compliance with these Terms and with applicable UK laws.


3. USER ACCOUNTS

3.1 Registration

Users must create an account to buy or sell services. You agree to provide accurate information and keep your account secure.

3.2 Account Responsibility

You are responsible for all activity conducted through your account.
Fwixit may suspend or terminate any account that violates these Terms.

3.3 Prohibited Activities

Users may not:

  • Offer or request illegal or harmful services.

  • Upload harmful code, malware, or attempt to breach platform security.

  • Engage in fraud, abuse, harassment, or misrepresentation.

  • Circumvent the platform by taking payments off-site.


4. SERVICES AND TRANSACTIONS

4.1 Listings

Freelancers may create service listings ("Services”) that clearly describe:

  • Service details

  • Pricing

  • Delivery times

  • Requirements from the Client

Freelancers must only offer services they can competently provide.

4.2 Orders

Clients place orders by purchasing a Freelancer’s service.
A legally binding agreement is formed between the Client and the Freelancer, not between the Client and Fwixit.


5. FEES AND COMMISSION

5.1 Platform Commission

Fwixit charges Freelancers a 20% commission on each completed order.
This fee is automatically deducted from the payout.

5.2 Payment Processing

  • All financial transactions are processed via PayPal.

  • By using Fwixit, you also agree to PayPal’s terms and conditions.

  • Fwixit does not store or directly handle your financial information.

5.3 Withdrawal of Earnings

Freelancers may withdraw earnings once an order is marked as completed and no dispute is active.
Withdrawal times may vary depending on PayPal processing.


6. REFUNDS & CANCELLATIONS

6.1 Client-Freelancer Negotiation

Clients and Freelancers should first attempt to resolve issues independently.

6.2 Platform Mediation

If a dispute cannot be resolved, Fwixit may intervene.
Fwixit’s decision is final and may include:

  • Full refund

  • Partial refund

  • No refund

Refunds will be processed back through PayPal.

6.3 Refund Limitations

Refunds may not be available if:

  • Work has already been delivered

  • The Client simply changes their mind

  • The Freelancer has completed the service as agreed


7. DISPUTES BETWEEN USERS

Fwixit may, at its discretion, review communications and project details to make a fair determination during disputes.
However, Fwixit has no obligation to mediate and does not guarantee outcomes.


8. INTELLECTUAL PROPERTY

8.1 Client Rights

Unless otherwise stated, ownership of delivered work transfers to the Client upon full payment.

8.2 Freelancer Rights

Freelancers retain rights to:

  • Pre-existing materials

  • Tools, templates, or code not specifically created for the Client

8.3 License Violations

Users may not:

  • Copy or resell a Freelancer’s work without proper licensing

  • Use delivered work unlawfully or for harmful purposes


9. PLATFORM RIGHTS

Fwixit reserves the right to:

  • Modify or remove content

  • Suspend or terminate accounts

  • Reject or cancel transactions

  • Change fees or features with reasonable notice

You agree that Fwixit is not liable for losses related to:

  • Service downtime

  • Account termination

  • User disputes

  • Inaccurate or misleading listings


10. PRIVACY

Your use of Fwixit is also subject to our Privacy Policy (provided separately), which explains how we collect, use, and protect your personal data in accordance with UK GDPR.


11. LIMITATION OF LIABILITY

To the fullest extent permitted by UK law:

  • Fwixit is not liable for any indirect, incidental, or consequential damages.

  • Fwixit does not guarantee the quality, legality, delivery, or outcome of any service purchased on the platform.

  • All services are provided "as-is” by Freelancers, who are solely responsible for their work.

Fwixit’s maximum liability shall never exceed the amount paid by the user to Fwixit in the prior 6 months.


12. INDEMNITY

You agree to indemnify and hold harmless Fwixit, its owners, staff, and affiliates from any claims arising from:

  • Your use of the platform

  • Your content or behaviour

  • Your violation of these Terms


13. TERMINATION

Fwixit may suspend or terminate any user account without notice if:

  • Fraud or misuse is suspected

  • Legal obligations require action

  • The user violates these Terms

Users may also delete their account at any time.


14. GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of England and Wales.
Any disputes will be handled exclusively by the courts of England and Wales.

 


15. CHANGES TO THESE TERMS

Fwixit may update these Terms periodically.
Continued use of the platform after changes means you accept the revised terms.
